Additional Terms
1. Beta Service
The Cloud Service is currently offered as a Beta under Section 17 of the Standard Terms. No warranty, indemnity, SLA or Support commitments apply. Notwithstanding Section 17, Provider's total liability during Beta will not exceed the fees paid by Customer in the thirty (30) days preceding the claim. The API may have breaking changes and may be modified or discontinued without notice.
2. Liability Cap
Notwithstanding Section 14.5 (General Cap) of the Standard Terms, the General Cap is the total fees paid by Customer to Provider in the thirty (30) days immediately preceding the first incident giving rise to liability.
3. Detection Accuracy and Performance
The Cloud Service uses deterministic, rule-based detection. Notwithstanding Section 6.2 (Performance Warranty) of the Standard Terms, Provider makes no warranty regarding the accuracy, completeness, or recall of detection results. PII detection may miss entities or produce false positives. SQL risk analysis may not identify all risk patterns in all query structures or dialects. Customer is solely responsible for all decisions made based on Service output. Service output is not a substitute for legal review or compliance certification. Provider targets low-latency responses but makes no guarantee as to any specific response time, throughput, or latency benchmark.
4. Personal Data Submitted for Detection
Notwithstanding Section 7.2 (High-Risk Activities and Sensitive Data) of the Standard Terms, Customer may submit text containing personal data to PIIGuard solely for the purpose of detecting and identifying that personal data. Customer represents that it has all rights necessary to submit such data and that its use of the Service complies with applicable data protection laws.
5. No Training on Customer Data
Provider will not use Customer Data to train models, build datasets, or improve detection algorithms. Customer Data is processed solely to return the Service response and is not retained after the response is delivered.
